Client was charged with stabbing her husband in the arm. Jury trial lasted approximately 4 weeks. After deliberating for 35 minutes, Jury delivered a unanimous verdict of not guilty on all charges based on self defense!

Case Description

Defendants were charged with possession of methamphetamine (approximately 703.9 grams), possession of marijuana (approximately 1263.6 grams), possession of MDMA (ecstasy-approximately 65.2 grams), and possession of LSD. Additionally, they were charged with possessing a .38 caliber revolver and .380 caliber pistol in the commission of above offenses. Defendants were indicted by the grand jury. Our office filed a motion to suppress the evidence based on an illegal search of the defendant’s house without a search warrant. Defense motion to suppress the evidence including all drugs and guns was granted. All charges were dismissed. Prior to defense motion to suppress evidence based on the defendant’s constitutional rights, the offer by the district attorney to defendant was 6 years.

Outcome

Case dismissed by district attorney after defense won the motion to suppress evidence including all drugs and guns.


Case Description

Defendant was charged with Vandalism where the prosecutor introduced evidence of prior incidents of misconduct similar to the current case. Defendant was acquitted at a jury trial.

Outcome

Not guilty on all charges after the jury deliberations that lasted less than an hour.

Defendant was charged with a DUI with a blood alcohol of .14/.15 in Santa Clara County.

Outcome

Defense filed a Serna Motion and all charges were dismissed based on lack of timely prosecution.


Case Description

Defendant was charged with Grand Theft. The court and the DA agreed to defer prosecution and if the client did not get in new trouble for a year, all charged would be dismissed.

All charges dismissed after one year of being in the deferred prosecution program.


Case Description

Defendant was due to be charged with a Robbery. After pre charge investigation, Defendant was charged with a Grand Theft and Assault. After plea negotiations, Defendant was able to plead to a single count of petty theft with probation.

Alameda County DMV suspended a client’s license due to his prescription of Methodone. At the hearing, defense presented evidence and argued that the licensee’s driving abilities were not affected by his prescription.

Outcome

DMV reinstated the license despite the Methodone prescription.
